MayreePix Academy & Design is a subsidiary of Denise Mayree and may hereby be referred to as the "company" for this document's purpose. The use of this website is subject to the following terms and conditions of use:

Welcome to Denise Mayree (Denisemayree.com) ("we," "us," "our," or the "Company"). Please read these Terms & Conditions ("Terms") carefully before using our website and services.

1. Acceptance of Terms
By accessing or using the services provided by Denisemayree.com, including but not limited to online Photoshop courses, membership for digital backgrounds and elements, and one-on-one mentorship sessions, you agree to comply with and be bound by these Terms.

2. Membership and Account
a. To access certain features of our services, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process.
​
b. You are responsible for maintaining the confidentiality of your account and password. You agree to notify us immediately of any unauthorized use of your account.
​
3. Courses and Mentorship Sessions
a. Our online courses and mentorship sessions are designed for educational and informational purposes. We do not guarantee any specific outcomes or results.
​
b. You may not share, sell, or distribute course materials without our explicit written consent.
​
c. Mentorship sessions are subject to availability and scheduling. We reserve the right to reschedule or cancel sessions as needed.

4. Membership and Membership Upgrade
a. Membership to our digital backgrounds and elements library is granted upon a one-time payment for a lifetime Membership. There are no recurring fees for basic membership.
​
b. Limited edition items may be released at specific times, and members have the option to purchase these items at a discounted cost. These purchases are separate from the lifetime membership fee and are not mandatory.
​
c. We reserve the right to introduce new limited edition items and modify their costs with prior notice to members.
​
d. The lifetime membership fee is non-refundable, except as required by applicable law.
​
e. We reserve the right to modify the terms of lifetime membership with reasonable notice to members.
​
5. Intellectual Property
a. All content provided on our website, including course materials and digital backgrounds and elements, is the intellectual property of Denise Mayree and is protected by copyright laws.

b. You may not reproduce, distribute, or create derivative works from our course materials or digital backgrounds and elements without our explicit written permission.
​
c. For digital backgrounds and elements included with the MayreePix Design membership:
​
YOU MAY NOT:
i. Sell or distribute MayreePix templates in Photoshop PSD or JPEG file format.
ii. Sell or distribute MayreePix templates on mass marketplaces like Etsy, eBay, or anywhere else in any format whatsoever.
YOU MAY:
i. Sell or distribute printed products or digital files in flattened form on your own website.
ii. Sell or distribute printed products or digital files in flattened form to your photography customers.

d. The licensing rights for digital backgrounds and elements are non-transferable and are solely for the use of the member. Any unauthorized use or distribution of these items may result in the termination of membership.

6. Product Copyright and Usage
a. Permitted standard uses include changing or modifying the template in any way for use in creating products for yourself or your customers.
​
b. Selling prints, cards, books, albums, or other printed/physical products that use the templates in whole or in part is allowed (limitations apply, see section below).
​
c. Under no circumstances may a user resell or redistribute either in part or whole, these templates for any reason, claim these designs as your own, or sell any design digital or printed on any online or offline store.

7. User Requirements and Responsibilities
a. Templates on this website are provided as Photoshop PSD files, or JPEG. Adobe Photoshop software is required to use and edit PSD templates.
​
b. It is the user's responsibility to have basic knowledge of using this software in conjunction with our templates.
​
c. Any website links to fonts provided in the downloads are for indication purposes only. It is the user's responsibility to check with the font owner for font licensing terms of use.

8. Printing Regulations
a. The user is responsible for checking and identifying the correctness of all file attributes before sending files to a printer.
​
b. Denise Mayree will not be held responsible for any errors arising during and after the printing process.
​
9. Privacy Policy
Your use of our services is also governed by our Privacy Policy.
​
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Calgary, Alberta Canada.

11. Legal Recourse
a. The user agrees to indemnify and hold Denise Mayree and its affiliates, employees, agents, and representatives harmless from and against any and all claims, demands, liabilities, expenses, losses, damages, and attorney fees arising from any and all claims and lawsuits for libel, slander, copyright, and trademark violation, as well as all other claims resulting from the participation of the user on denisemayree.com.

b. The user also agrees to indemnify Denise Mayree for any legal fees incurred by Denise Mayree, acting reasonably, in investigating or enforcing its rights under this agreement.

12. Cancellation Policy
Members are billed on a one-time lifetime membership basis. Members may cancel their account at any time via their member account. As soon as you cancel your membership, you will no longer be able to download member-only resources. Resources that you’ve downloaded before canceling will be yours to keep.

13. Termination of Agreements & Refunds Policy
MayreePix Academy & Design reserves the right to terminate any account/user for any reason whatsoever as deemed necessary. A membership to MayreePix Design is non-refundable, except in the event of multiple charges or mistakes on our part. All other refund requests will be handled on a case-by-case basis.

14. Notification of Changes
The Company reserves the right to change these conditions from time to time as it sees fit and without notice. Your continued use of the site will signify your acceptance of any adjustment to these terms. Please review these Terms of Use periodically.
